Is Everyone required to have a Fishing License?
« on: November 04, 2009, 03:56:18 PM »
Trolling last weekend with 3 licensed anglers and 1 guy without.  What happens when a license check occurs.  We debated this, is everyone assumed to be fishing? is there a rule?

I think that it depends a lot on the LEO that is conducting the check.Where I fish they don\'t push the license for each angler-they like to make sure that a limit hasn\'t been exceeded for any type of fish.Besides, somebody has to be driving the boat-don\'t they?

There are some exeptions also listed at the FWC web site. For example, military from Florida at home on leave \"assume they\'ll need driver\'s license and orders\". Or the very old and the very young.

Note......personally I find  65 is not near as old as it used to be.

379.354\"1\"  LICENSE, PERMIT, OR AUTHORIZATION NUMBER REQUIRED.-- \"a\"  Except as provided in s. 379.353, no person shall take game, freshwater or saltwater fish, or fur-bearing animals within this state without having first obtained a license, permit, or authorization number and paid the fees set forth in this chapter. Such license, permit, or authorization number shall authorize the person to whom it is issued to take game, freshwater or saltwater fish, or fur-bearing animals, and participate in outdoor recreational activities in accordance with the laws of the state and rules of the commission.

Take means--379.101\"38\"  \"Take\" means taking, attempting to take, pursuing, hunting, molesting, capturing, or killing any wildlife or freshwater or saltwater fish, or their nests or eggs, by any means, whether or not such actions result in obtaining possession of such wildlife or freshwater or saltwater fish or their nests or eggs.

You have to be engaged in fishing \"take\" not just riding along.  However;  don\'t have bag limits for four people in your situation just for three.
